Welcome to Popcorn FM! These Terms and Conditions ("Terms") govern your use of the Popcorn FM mobile application (the "App"), our website, and the services provided therein (collectively, the "Service"), operated by Enceladus Digital Studios ("Popcorn FM," "we," "us," or "our").

1. Acceptance of Terms

By downloading, creating an account, or using our Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you may not use the Service.

2. User Accounts & Eligibility

• Eligibility: You must be at least 16 years old to use the Service. If you are under 18, you represent that you have permission from your parent or legal guardian to use the Service.
• Registration: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate. You are solely responsible for all activities that occur under your account and for safeguarding your password.

3. The "Corns" Virtual Currency System

Our Service uses a virtual currency called "Corns" to access premium content.

• Acquiring Corns: Corns can be acquired in several ways: (a) by purchasing them through our in-app payment system; (b) by earning them through promotional activities, such as daily logins or completing a series; or (c) by opting to watch rewarded advertisements.
• Using Corns: Corns can be used to unlock premium audio story episodes and other features within the App.
• No Monetary Value & Non-Refundable: Corns are not real-world currency and have no monetary value. They cannot be sold, transferred, or redeemed for cash. All purchases of Corns are final and non-refundable. We reserve the right to manage and regulate Corns at our discretion.

4. Grant of License to Use the Service

Popcorn FM grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial entertainment. You agree not to use the Service for any public performance.

5. User Content & Contributions

• Responsibility: You are solely responsible for any content, feedback, or materials you submit or contribute to the Service ("User Content"). You agree not to post any User Content that is illegal, defamatory, infringing on intellectual property rights, or otherwise harmful.
• License to Popcorn FM: By submitting User Content, you grant Popcorn FM a worldwide, non-exclusive, royalty-free, perpetual, and transferable license to use, reproduce, modify, distribute, display, and create derivative works of your User Content in connection with operating and promoting the Service.

6. Intellectual Property Rights

All content on the Service, including the audio stories, text, graphics, logos, images, and software (the "Popcorn FM Content"), is the exclusive property of Popcorn FM or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from the Popcorn FM Content without our express written permission.

7. Account Suspension & Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice or liability, for any reason, including if you breach these Terms or engage in fraudulent or illegal activity.

8. Disclaimers and Limitation of Liability:

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, Popcorn FM disclaims all warranties, express or implied. In no event shall Popcorn FM be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Service.

9. Indemnification

You agree to indemnify and hold harmless Popcorn FM and its affiliates, officers, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

10. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of India. Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, shall be subject to the exclusive jurisdiction of the courts in Coimbatore, Tamil Nadu.

11. Changes to Terms

We may modify these Terms at any time. We will notify you through email or app notification or any other means possible of any changes by posting the new Terms on this page. Your continued use of the Service after any such change constitutes your acceptance of the new Terms.
